Antitrust law, derived from the American Sherman Antitrust Act of 1890, is a set of laws and regulations designed to protect consumers’ freedom to choose, promote competition, and prevent businesses from engaging in unfair methods and practices that stifle competition and create a monopolistic environment. The core of antitrust law is to enjoin, regulate and punish entities that have colluded, conspired, or have engaged in activities that deprive customers of the right to purchase goods and services at a fair price.

These laws are passed by Congress and enforced by the US Department of Justice (DOJ) and Federal Trade Commission (FTC). The DOJ’s primary jurisdiction to regulate competition is in enforcement of the Sherman Antitrust Act, as well as civil and criminal antitrust laws. The FTC is primarily responsible for preventing or addressing unfair acts or practices that may, for instance, harm consumers, such as fraudulent advertising or deceptive marketing.

The two most commonly used complaint mechanisms of antitrust law include treble damages, which are a type of punitive damages that occurs when a person or corporation has wrongfully gained a financial benefit and the courts will award three times the amount of economic benefit as compensation, and injunctions that prohibit defendants from engaging in particular anti-competitive activities.

The effects of anti-trust laws are broad and far reaching. With the goal of protecting competition and preventing large companies from becoming monopolies, antitrust laws aim to level the playing field and ensure a fair market for all participants.
