Regulation on the Handling of Accidents of Pressure Vessels, Boilers and Special Equipment Pressure Pipes
▪ Article 1 These Regulations are formulated for the purpose of preventing and controlling accidents of pressure vessels, boilers, pressure pipes and other special equipment in accordance with the relevant regulations of the State.
▪ Article 2 State-owned enterprises, private enterprises, institutions, social organizations and individuals that design, manufacture, install, inspect, repair and use pressure vessels, boilers, pressure pipes and other special equipment (not including locally manufactured pressure vessels and boilers) shall comply with these Regulations.
▪ Article 3 A pressure vessel, boiler or pressure pipe operator should, in accordance with the relevant safety management regulations, formulate safety management regulations and rules, carry out safety evaluation and assessment of pressure vessel, boiler and pressure pipe use, and accept supervision and inspection.
▪ Article 4 A pressure vessel, boiler or pressure pipe that is newly designed, manufactured, installed and repaired shall comply with the relevant technical specifications and pass the relevant inspection procedures before they can be put into operation and use.
▪ Article 5 A pressure vessel, boiler or pressure pipe operated by a user should be subjected to periodic inspection. There must be special personnel to examine, repair and maintain the pressure vessel, boiler and pressure pipe, and any alteration and additional work must be approved by competent units.
▪ Article 6 Any person who is in charge of or who is engaged in the operation of pressure vessels, boilers and pressure pipes should abide by the safety requirements of pressure vessels and boilers. The installation, commissioning, operation and maintenance personnel of pressure vessels, boilers and pressure pipes must possess the necessary professional knowledge, technical skills and safety awareness, as well as the qualifications for engaging in pressure vessels, boilers and pressure piping operations and safety management activities.
▪ Article 7 Imported or domestically produced pressure vessels and boilers should concentrate on the inspection, repair, overhaul and utilization of the pressure vessels and boilers in accordance with the Rules, and should not be used in violation of the prescribed specifications.
▪ Article 8 The operator of the pressure vessel, boiler and pressure pipe should, in accordance with the safety management regulations and rules, set up special personnel to assume responsibility for the safety inspection and management of the pressure vessel, boiler and pressure pipe, and carry out safety inspections in a timely manner.
▪ Article 9 Measures should be taken to prevent accidents. All personnel engaged in work related to pressure vessels, boilers, pressure pipes and other special equipment should wear protective equipment and strictly abide by safety procedures and regulations.
▪ Article 10 All enterprises, institutions, social organizations and individuals engaged in the design, manufacture, installation, inspection and use of pressure vessels, boilers, pressure pipes and other special equipment should provide required training and safety education for their personnel and any personnel engaged in the operation of pressure vessels, boilers and pressure pipes should attend relevant safety training and safety education.
▪ Article 11 On discovery of any leakage, cracking or damage to pressure vessels, boilers, pressure pipes, or other special equipment or any accident of overpressure, enterprises, institutions, social organizations and individuals shall immediately report the situation to the relevant authority and take effective measures to eliminate the harm.
▪ Article 12 When an accident of a pressure vessel, boiler or pressure pipe occurs, the accident must be dealt with by the relevant personnel, in accordance with the relevant safety regulations and rules, to prevent further losses and damages, and to ensure the safety of the personnel.
▪ Article 13 Disposal personnel of an accident of pressure vessels, boilers,pressure pipes, and other special equipment shall strictly adhere to safety regulations and rules which have been formulated in accordance with the relevant regulations of the State and cause no more losses or damage because of inappropriate disposal.
▪ Article 14 Personnel engaging in accident disposal shall make timely and complete record of accidents,collect relevant evidence and take photos if necessary,and report to the supervision and management authority in charge in accordance with related laws and regulations.
▪ Article 15 The people’s government of the county or above shall set up a authority to be responsible for supervision and management of accidents caused by pressure vessels, boilers, pressure pipes and other special equipment.
▪ Article 16 If a violation of this regulation constitutes a crime, it shall be handled in accordance with the criminal law.
▪ Article 17 These Regulations shall enter into force as of the date of promulgation.
