Hire Boat Agreement
This Hire Boat Agreement (the “Agreement”) is made and entered into this Day of , 2020, by and between [Hirer], having his/her/its address at [ Address] (the “Hirer”), and [Owner], having his/her/its address at [Address] (the “Owner”).
WHEREAS, the Owner is the owner ofPleasure Craft [Name], having its registered office at [Address] (the “Boat”);
WHEREAS, the Hirer desires to hire the Boat from the Owner for the purpose of a pleasure cruise on the specified dates in exchange for the payment of the applicable fees
NOW THEREFORE IN CONSIDERATION OF THE MUTUAL COVENANTS AND AGREEMENTS HEREIN CONTAINED, THE PARTIES HERETO MUTUALLY AGREE AS FOLLOWS:
1. HIRE: the Owner hereby agrees to hire the Boat to the Hirer, and the Hirer hereby agrees to hire the Boat from the Owner, in consideration of the payment of a fee as specified in the attached Annexure A (the “Fee”).
2. TERM: The Hirer must return the Boat to the Owner on the agreed date and time shown on Annexure A to this Agreement (the “Return Date”).
3. FARE: The Hirer will pay the Fee to the Owner within the period of 14 days prior to the commencement of the Pleasure Cruise.
4. DELIVERY: The Owner shall deliver the Boat to the Hirer on the agreed date and time shown on Annexure A to this Agreement (the “Hire Date”). The Hirer shall ensure that when receiving the Boat upon delivery that a check is done and all necessary equipment is in working order.
5. REMOVAL AND RETURN: The Hirer is responsible for returning the Boat to the Owner on the agreed Return Date and on time, and in the same conditions as when it was received.
6. MAINTENANCE: The Hirer must ensure that all necessary maintenance works are carried out and that the Boat is kept in good condition.
7. DAMAGE AND LOSS: The Hirer is responsible for any loss or damage to the boat, its equipment or fittings, however caused. In the case of loss or damage, the Owner will receive the cost of repair to the boat, its equipment or fittings.
8. INSURANCE: The Hirer must purchase the necessary insurance to cover the boat during the period of hire.
9. GOVERNING LAW AND JURISDICTION: This Agreement shall be governed by and construed in accordance with the laws of [Country], and the parties agree to submit to the non-exclusive jurisdiction of the courts of [Country] for the resolution of any disputes or differences.
10. INDEMNITY: The Hirer hereby indemnifies and holds harmless the Owner from and against any and all losses, claims, liabilities, damages, costs, and expenses arising out of or in connection with the hire of the boat.
