The management regulations of the industrial product production license of the Peoples Republic of China
Article 1 This regulation is formulated in accordance with the Product Quality Law of the Peoples Republic of China, in order to strengthen the management of industrial product production license, ensure product quality and protect the legitimate interests of consumers.
Article 2 The industrial products referred to in this regulation are products or products made by industrial technology, except for otherwise specified products or services.
Article 3 The standard for granting and revoking industrial product production license shall be formulated by the State Council of the Peoples Republic of China, and legal documents shall be issued by the industrial and commercial administrative departments according to the standards.
Article 4 Industrial and commercial administration departments are responsible for the management of industrial product production license, and the industrial and commercial administrative departments of provinces, autonomous regions and municipalities directly under the Central Government shall specify the industry, category and production license issuing and revoking department of their respective jurisdictions.
Article 5 An enterprise applying for industrial product production license shall submit the following documents to the department of application:
1. Application for industrial product production license
2. Name list of the responsible persons
3. A copy of the product quality manual
4. Regulatory documents related to the product
5. A copy of the factory address
Article 6 the issuing of industrial product production license shall be subject to the following requirements:
1. The applicant and its responsible persons have the qualification and conditions for operating production activities and can guarantee that their products meet safety, health, environmental protection and other relevant requirements.
2. Having relevant regulations, specifications and standards for quality assurance, exchange, return and quality supervision and inspection.
3. Having a quality management system, a product quality control system and a quality assurance capability.
4. Having a qualified production environment and equipment as required by related standards and regulations.
Article 7 In the course of the examination of the application for the production license, the applicant shall, in accordance with the regulations of the issuing department, submit the quality manual, specification documents and other related documents to the issuing department. The issuing department shall verify the documents on the spot.
Article 8 Where the issuing department has examined and approved the application, the industrial product production license shall be issued; where the application cannot be approved, the issuance of the industrial product production license shall be denied and the reasons shall be given.
Article 9 The industrial product production license shall be valid for five years. The current licensee shall apply for the renewal one month before the expiration of the production license, so that the renewal of the license can be completed before the expiration of the production license.
Article 10 The industrial and commercial administration departments shall make an announcement in the local area administrative journal on the issuance and revocation of the industrial product production license.
Article 11 The licensee shall comply with the following obligations in practice:
1.The licensee shall produce the product in strict compliance with the product quality manual and quality regulations, and shall accept the supervision and inspection of the relevant authorities.
2.The licensee shall publicly give the address and nature of the factory and the serial number, validity period, raw material place and various cooperation situations of the license.
3.The licensee shall use the issued license card and it shall not be changed, transferred, lent or destroyed without authorization.
Article 12 Renewal of industrial product production license shall be subject to the following requirements:
1. The licensee shall fulfill its obligations concerning product quality, work safety and environmental protection in accordance with the requirements of related laws and regulations.
2. Having a qualified production environment and equipment and complying with related standards and regulations.
3. Maintain valid quality management documents and submit them to the Department for verification and examination.
Article 13 The Department shall issue a notice on the revocation of the industrial product production license when the industrial product production license is revoked in accordance with relevant regulations.
Article 14 The Department shall investigate and sanction for violations of the regulations on industrial product production license in accordance with the stipulations of the Product Quality Law of the Peoples Republic of China.
Article 15 This Regulation shall come into force on the date of its promulgation.
