Goods Export Permit Management Regulations

In order to further regulate export activities, and to protect the interests of imported and exported goods, these Regulations are hereby promulgated.

Article 1 The scope of application of these Regulations

1. These Regulations are applicable to the permit management of goods export.

2. These Regulations shall apply to the activities of export of goods such as Chinese commodities, agricultural products, and other related items from the Chinese mainland, as well as the activities of foreign-funded enterprises and cooperatives in China.

Article 2 Responsibilities for Permit Management

1. The Administration for Industry and Commerce of the providing local authority shall accept applications for goods export permits, examine the applications, and make a decision whether to approve them in accordance with law.

2. The customs authority shall obtain and/or issue the goods export permits in accordance with relevant laws and regulations.

Article 3 The application for permit

1. For the application of permit, the applicant shall submit the application form, relevant documents, and the goods export permit fee. The local customs shall handle the registration and the issuance of the goods export permit.

2. The applicant shall provide the following documents when applying for the goods export permit:

(1) The business registration certificate or other relevant documents proving the legal identity of the enterprise;

(2) The owner’s proof of identity, or the authorized representative’s proof of identity;

(3) The goods export permit applied for must be in accordance with the list of goods approved by the Ministry of Commerce.

Article 4 Examination and Approval of Permits

1. The customs authority shall review the application documents submitted by the applicant, and decide whether to approve it or not.

2. If the application is approved, the customs authority shall issue a goods export permit to the applicant.

3. The goods export permit is valid for one year from the date of issue unless the permit expires earlier due to circumstances.

Article 5 Penalty

1. If an applicant without a goods export permit engages in export activities, the customs authority shall, in accordance with law, revoke all the permits granted to the applicant and impose a fine of up to 500 yuan.

2. If a permit holder fails to comply with the requirements specified in the goods export permit, the customs authority shall, in accordance with law, revoke the permit and impose a fine of up to 500 yuan.

3. In the event of any violations of the goods export permit, the customs authority can impose a fine of up to 1,000 yuan.

Article 6 These Regulations shall enter into force as of the date of promulgation.
