PRC Regulation on Anti-dumping

In recent years, due to the rapid development of international trade, the problem of dumping has become increasingly serious. Many countries have imposed anti-dumping measures to protect the interests of their own industries. The Chinese government has also formulated the Anti-dumping Regulation of the Peoples Republic of China (hereinafter referred to as the Regulation) to protect domestic enterprises and safeguard fair competition in the market. This article will introduce the major contents of the Regulation and its significance to economic growth in China.

The Regulation defines “dumping” as a country selling a commodity to another country at an export price which is lower than the normal value of that commodity on the domestic market of the exporting country. It also stipulates restrictions on the export of dumped commodities. Specifically, the Regulation prohibits dumping if it seriously damages the legitimate interests of domestic enterprises or the general public, or if it affects the normal development of the export industry or other industries in the exporting country.

The Regulation further provides for the establishment and supervision of anti-dumping investigations. When the investigations find that there is dumping, the regulations set out a series of countermeasures for the importing country. These include imposing anti-dumping taxes, setting up tariff quotas, or collecting additional duties on imported commodities, with the aim of compensating for the unfair advantages enjoyed by the exporters of these commodities.

The Regulation is also aimed at promoting fair trade practices among countries. To this end, it permits the filing of anti-dumping complaints against foreign producers, and provides detailed guidance on the handling of such cases. Furthermore, the Regulation grounds its regulations against dumping on the principles of equality, reciprocity, and mutual benefit, and calls for increased coordination among countries in the enforcement of the Regulation.

The PRC Regulation on Anti-dumping is significant to the economic growth of China. Firstly, it will protect legitimate interests of Chinese enterprises. Secondly, it will also promote fair competition in the market, so that competitive businesses will be motivated to increase their capabilities, thus driving growth. Finally, it will also serve to reduce trade distortions resulting from dumping, thus ensuring balanced and healthy trade relations with foreign countries.

Overall, the regulation on anti-dumping serves as an important tool for China to guard against dumping and promote fair international trade practices. It will help China to protect its domestic enterprises, promote healthy competition and foster economic growth in the future.
