International Labor Contract T his International Labor Contract (hereinafter referred to as the “Contract”) entered into on this day, ___________ , 2020 (hereinafter referred to as the “Execution Date”), by and between the following two parties: Party A， a company organized and existing under the laws of China and with its principal place of business located at _____________________[Address]； (hereinafter referred to as the “Company”); Party B， ____________________[Name] from ____________________[Country] (hereinafter referred to as the “Individual”).
WHEREAS：
A. The Company desires to enter into this Contract with the Individual for describing in detail the respective rights, duties and obligations of each of the parties for the provision of an international labor service.
B. The Individual desires to provide an international labor service through this Contract.
NOW THEREFORE， the parties hereto hereby agree as follows：
1. Subject Matter
1.1 Under this Contract, the Individual agrees to work with the Company under its instructions and managerial supervisory scope pursuant to the terms and conditions stated herein. The individual shall provide a labor service in accordance with the Company’s instructions for the Company for 6 months starting from the Execution Date herein. The parties acknowledge and agree that the length of the labor service provided is not non-specific and that it may be extended or renewed by mutual agreement of the parties from time to time..
1.2 The individual agrees to work following the local labor law of China. The Company agrees to make sure that the work of the individual is included in the company’s labor contract and to bear any responsibility according to the labor law of China.
2. Working Hours
2.1 During the term of this Contract, the individual shall devote its entire working time, effort and attention to provide the international labor service to the Company. The Company shall normally require the individual to work no more than 10 hours a day, with one hour break in between the working hours. The total working hours per week shall not exceed 40 hours. The individual shall be entitled to at least one day off per week, except when there is an extraordinary situation.
2.2 If the individual needs to work overtime, the Company shall pay for the overtime at an agreed-upon rate. The overtime rate shall not be less than the basic salary.
3. Compensation
3.1 The Company shall pay the individual a salary of ______________ (___ [ Currency]) per month during the term of the Contract.
3.2 The Company shall make all payments to the individual in RMB or the US Dollar at the conversion rate of 1 US Dollar to 7 RMB, as applied at the time of payment.
3.3 The Company shall pay the salary of the individual on the 15th day of every month or, if the 15th falls on a weekend, then the payment shall be paid on the next working day.
3.4 The Company shall also reimburse the Individual on a monthly basis for any reasonable and necessary business and work-related expenses, subject to prior authorization by the Company.
4. Insurance
4.1 The Company shall take out and pay for Accident Insurance for the individual. The insurance shall cover the individual in the event of any accident or injury that may arise during the performance of the labor service for the Company.
5. Termination
5.1 This Contract may be terminated by either party by giving one month’s written notice.
5.2 The Company shall be entitled to terminate or suspend this Contract, with immediate effect, upon breach of contractual provisions by the individual or if the individual deviates from the labor service as specified in this Contract.
6. Miscellaneous
6.1 The Company has the right to assign certain tasks to the individual, if necessary. The individual shall meet the requirements of the assigned tasks and shall not breach any of the provisions in this Contract.
6.2 This Contract is subject to the laws of the Country where the Australian Embassy is located in. Any dispute hereunder shall be finally settled by the courts in the Country where the Embassy is located.
