Regulations of Publishing Management
1 Introduction
Publishing is a very important part of the modern world. It is important for us to maintain exclusive control and management of what is printed and published in order to ensure public order, security, and good morals. The Regulations of Publishing Management are hereby prescribed to standardize the publishing market, strengthen industry regulation, and create an environment conducive to the sound development of the publishing industry.
2 Definitions
(1)“Publishing” as used in these regulations refers to the physical and electronic reproduction, publication, distribution and sale of print works, as well as the registration of copyrights and the management of related rights.
(2) “Orders for Publications” as used in these regulations refers to contracts or agreements between publishers and other entities for the publication and/or distribution of print works.
(3) “Author” as used in these regulations refers to a natural or legal person who has rights to the content of a print work.
(4) “Manufacturers” as used in these regulations refers to natural or legal persons engaged in the production and printing of printed materials.
3 Scope of Application
The Regulations of Publishing Management apply to all publishers, authors, and manufacturers of print works that are established, acquire, or carry out business in the People’s Republic of China.
4 Restrictions
(1)It is prohibited to publish any works that:
a) Endanger national unity, sovereignty and territorial integrity;
b) Incite national hatred, ethnic discrimination, and undermine national unity;
c) Disseminate superstition, obscenity, pornography, gambling, violence, and terrorism;
d) Disseminate false or distorted information which is destructive to the country’s honor and interests, or disturbs social order;
e) Infringe upon the rights and interests of citizens, legal persons, or other organizations;
f) Violate state regulations or laws;
g) Are deemed inappropriate by the publishing authorities.
(2) It is prohibited to reprint or reproduce any works of other publishers without obtaining authorization and paying royalties.
(3) It is prohibited for any publisher to abuse its market dominance to damage fair competition.
5 Rights Protection
(1) Publishers shall strengthen the protection of authors’ rights and interests by signing contracts with authors and making sure they are respected.
(2) Authors shall be compensated according to the contractual agreement with the publisher.
6 Management
(1) The publishing authorities shall take accountability for the implementation and enforcement of the Regulations of Publishing Management.
(2) Publishers shall practice self-regulation, inspect and implement the Regulations of Publishing Management, and report to the publishing authorities any violations they discover.
(3) All publishers shall register with the publishing authorities before conducting publishing business.
(4) All print works shall be reviewed and approved by the publishing authorities before being published.
7 Supervision and Inspection
The publishing authorities shall monitor and inspect the publishing market for compliance with the Regulations of Publishing Management. Authority shall investigate and handle violations according to laws and regulations.
8 Other Provisions
These Regulations shall enter into force on the day of publication. The publishing authorities shall be responsible for the interpretation of these Regulations. Any matters not provided for in these Regulations shall be handled in accordance with relevant laws and regulations.
