The principle of Prussian jurisprudence is the concept that legal statutes should be just, clear, and precise; meaning, they should be written in such a way that the terms and definitions of a law are clearly defined, that all parties involved in a situation understand their obligations and rights, and that there is no margin of interpretation of a laws intent or context. This concept of a strict interpretation of a law has been applied to the Prussian Statutory Code since its inception, though it has evolved since its original framing.
At its simplest, the Prussian Statutory Code is designed to guarantee and protect the rights of citizens, establish a standardized system of laws, and to ensure uniformity and clarity in all legal matters. As such, the Code applies to all citizens of the Prussian Empire, regardless of status or station, and seeks to maintain consistency in the application of laws. This is accomplished by demanding a strict interpretation of the Codes language, while allowing for some degree of interpretation when applied to specific situations.
The Code consists of two main parts: the General Part and the Special Part. The General Part, which has been applied since the 19th century, consists of the main branches of law that apply to all Prussians and, as such, is often regarded as the “heart and soul” of the Prussian legal system. This section is divided into eleven main divisions, each of which contains various laws related to civil rights and obligations, labor, commerce, property, penal, fiscal, and other legal matters. These laws are all intended to provide a comprehensive and uniform basis for the regulation and protection of citizens throughout the empire.
The Special Part, which was added in the early 20th century, deals with matters of specific Prussian origin. This includes rules and regulations concerning things like titles of nobility, military organization and recruitment, and the general organization of the army. Additionally, this section contains a variety of laws that apply to the relationships between Prussian citizens and its foreign citizens, such as rights protecting foreign nationals.
Although the General Part has been the focus of Prussian jurisprudence since its inception, both sections are given an equal importance in terms of their application to legal matters in the Prussian Empire. This is due to the fact that various laws governing particular matters of Prussian origin may need to be supplemented by the General Part in order to ensure the protection of the rights and liberties of its citizens. As such, both sections are intended to coincide with one another and, when deemed necessary, the more specific laws of the Special Part will supersede those of the General Part when applicable.
The Prussian Statutory Code is, by definition, a living document, subject to changes time and time again in order to meet the changing needs of Prussian society and the legal environment. This is accomplished by a handful of well-respected legal scholars and universities called in to review the code and recommend changes when necessary. Most of their reviews are based on scientific and empirical evidence, with an emphasis on protecting the rights of Prussian citizens at all times.
For many centuries, Prussian jurisprudence has been a cornerstone of civil justice and legal protection throughout much of Europe. The laws created throughout the centuries have been carefully constructed to ensure the rights and freedoms of every Prussian citizen are respected and preserved, while also providing a legal framework that eliminates any ambiguity or discrepancy.
