Introduction

The safety management of hazardous chemicals is a matter of great importance to the public’s health and safety. Scope

Definitions

In this Regulation, the following terms shall have the following meanings:

“Hazardous chemicals” shall mean substances with properties that place workers, the public, or the environment in danger if used improperly.

“Operator” shall mean any person or organization responsible for the handling, storage, or disposal of hazardous chemicals.

“Vessel” shall mean any ship, barge, tanker, aircraft, container, or other structure carrying hazardous chemicals.

Requirements

Operators shall comply with the following requirements:

1. Operators shall develop and implement management plans to ensure the safe handling and storage of hazardous chemicals under their control. Such plans shall include, but are not limited to, provisions for the proper labeling of hazardous chemicals, training of personnel, emergency response, and containment and cleanup of spills or releases.

2. All vessels and containers used to store hazardous chemicals shall be properly maintained and regularly inspected.

3. All personnel working with or exposed to hazardous chemicals shall receive comprehensive safety training and shall be provided with personal protective equipment when necessary.

4. Operators shall keep detailed records of all hazardous chemicals under their control. These records shall include the quantity, type, and location of the hazardous chemicals, as well as any emergency response plans and protocols.

5. Operators shall ensure that emergency response plans and protocols are in place to address any accidental spills, releases, or other hazardous events involving hazardous chemicals.

6. Operators shall develop and implement procedures for disposing of hazardous chemicals in a safe and responsible manner.

7. Operators shall comply with all applicable local, state, and federal regulations for the storage, handling, and disposal of hazardous chemicals.

Enforcement

Compliance with this Regulation shall be monitored by the relevant local, state, or federal governmental agencies. Penalties, including fines and/or imprisonment, may be imposed for violations of this Regulation.
