Article 1: Meaning of Terms
1. International maritime transport refers to the international maritime transportation of goods and passengers by vessels.
2. International shipping agency refers to a mainland enterprise engaged in the international maritime transport business, providing international maritime transport agency services to consignors, consignees, shippers or shipowners, and bearing relevant legal responsibilities.
3. Liner transportation refers to the transportation of goods and passengers by vessels signed by a shipping company or an enterprise authorized by the shipping company.
4. Non-liner transportation refers to the transportation of goods and passengers by vessels that the shipper entrusts, ushers and dispatches the consignee to charter the vessel.
Article 2: Registration of International Shipping Agencies
1. International shipping agency registration shall be submitted to the maritime administration, and the registration of international shipping agency shall comply with relevant state regulations.
2. The applicant shall submit the following application materials to the maritime administration upon application for registration of international shipping agency:
(1) Application forms (including the proposed name of the international shipping agency, office address, business scope, organizational structure, business plan and other related information);
(2) Business registration license and organization code certificate;
(3) Business contract;
(4) Organization chart;
(5) Copy of identification documents of the representatives of the agency and the signature and seal of the legal representative;
(6) Audit materials;
(7) Other materials related to application.
3. If a foreign-invested enterprise intends to carry out the international shipping agency business, the applicant shall also provide the relevant materials for examination and approval of foreign investment.
4. After acceptance of the application for registration of international shipping agency, the maritime administration shall accept the application material and make a decision to pass or reject the application.
Article 3: Operation Rules of International Shipping Agency
1. International shipping agencies shall abide by international shipping agency regulations and provide customers with related services in accordance with the relevant provisions.
2. International shipping agencies shall sign a business contract with the consignor, consignee, shipper or shipowner, indicating the cost and responsibility of the services provided.
3. International shipping agencies shall abide by relevant labor and social security laws and regulations and shall properly manage employees, and shall pay social insurance funds in accordance with the regulations.
4. International shipping agencies shall do a good job in safety management and abide by safety regulations.
5. International shipping agencies shall strengthen business management, abide by economic and trade laws and regulations, pay taxes and fees in accordance with the regulations and carry out international shipping agency business in strict compliance with laws and regulations.
Article 4: Supervision and inpection of International Shipping Agencies
The maritime administration shall exercise supervision and inspection over the operation of international shipping agencies within its jurisdiction in accordance with the relevant laws and regulations, and if any violation is found, it shall give punishment according to law.
