The Statistical Law of the Peoples Republic of China
China, a major developing nation, is the largest developing country in the world. Its population and economy are both growing rapidly, and the nation has prioritized development since the establishment of the Peoples Republic in 1949. To ensure the orderly development of the economy and to better serve the people, the Chinese government has established a variety of laws and regulations, including the Statistical Law of the Peoples Republic of China. This law, enacted in December 2018, is effective as of Jan 1, 2019 and is aimed at strengthening data collection and analysis methods, ensuring the timeliness, accuracy, and confidentiality of statistical information, and protecting the vital interests of the public.
The Statistical Law of the Peoples Republic of China is divided into six articles, providing the legislative framework for the comprehensive use of statistics in China. The first article defines the purpose of the law, stating that it is “to strengthen the statistical system, promote the standardization, scientificization and informatization of statistical work, and ensure accurate, true and timely statistical information,” while protecting the privacy of citizens. Article 2 outlines the responsibilities of statistical institutions and personnel, requiring statistical institutions to integrate resources and personnel and to be responsible for the accuracy and timeliness of their statistical data collection, analysis and disclosure. Article 3 requires the national and local governments to formulate and revise their own statistical regulations in accordance with their specific economic and social conditions, while maintaining compliance with the Statistical Law of the Peoples Republic. Article 4 states that the national statistics department is responsible for coordinating the nations statistical work, while the provinces, autonomous regions, and municipalities are responsible for managing their own respective statistics departments. Article 5 further defines the objectives, methods, and personnel for statistical survey activities. Finally, Article 6 outlines the punishments for violations of the Statistical Law, including fines, suspend of service, or even criminal charges for serious violations.
The Statistical Law of the Peoples Republic of China is a necessary, logical piece of legal framework to ensure the integrity of statistical information. The law is part of Chinas larger effort to fight against corruption, maintain socioeconomic justice, and promote the development of the national economy. It is expected to play an important role in the economic and social development of China as the nation moves towards a more advanced, digitized economy.
